The well-known Nigerian on-air personality Ifedayo Olarinde, better known by his stage as Daddy Freeze, was fined ₦5 million for adultery by the Court of Appeal in the capital city of Rivers State, Port Harcourt. The ruling was upheld.
Recall that on February 18, 2021, Daddy Freeze was forced to pay ₦5 million by a High Court in Port Harcourt, Rivers State, for having an adulterous relationship with Benedicta Elechi.
Paul Odekina, who was Elechi's spouse at the time of the affair, was ordered to receive this money.
The court's ruling read as follows: "Ifedayo Olarinde, the second cross respondent to the cross petition, is awarded ₦5,000,000 as damages for depriving the cross petitioner of his wife's amiable consort (Petitioner/1st)." cross respondent) and for damages incurred as a consequence of his adultery with the cross respondent/petitioner.
In addition, because of her extramarital affair with Daddy Freeze, the court also declared Benedicta's marriage to Paul null and void.
Daddy Freeze filed an appeal with the appellate court because he was dissatisfied with the ruling of the High Court. His principal points of contention on appeal were that Order 7 Rule 2 of the Trial Court's Rules had been broken by Odekina's failure to physically seek to serve him prior to requesting substituted service.
Additionally, he maintained that non-service violated the principles of natural justice and that the alleged replacement modes of serving—that is, by courier—were unsuccessful, as shown by the affidavit of service.
In the June 26, 2024, judgment's Certified True Copy, the three-man Daddy Freeze's appeal was dismissed by a panel of Justices Abubakar Talba, Danlami Senchi, and Hannatu Balogun due to lack of merit.
