Olukayode Dayo, 39, was found guilty of rape and given a life sentence by the Ekiti State High Court, which is located in Ado Ekit.
The defendant, a former member of the Nigeria Security and Civil Defence Corps (NSCDC), was charged with one count of attempted rape on May 13, 2022, in a courtroom presided over by Justice Lekan Olatawura.
According to the charge, Olukayode Dayo sexually assaulted a 13-year-old girl on December 25, 2021, in Ado Ekiti, within the jurisdiction of the Honorable Court.
The indictment states that the offense violates Ekiti State's 2012 laws, namely Section 31(2) of the Child's Rights Law, Cap. C7.
In her statement, the victim "I was living with my grandmother, who sent me home to go and bring banana and kolanut," the man claimed to the police. While I was riding my motorcycle home, a man named Olukay (the defendant) ran me over, put a banana and a kolanut on my head, and led me to an incomplete, fenced-in building.
"I yelled at him, but he ignored me. He took off my pants and began having sex with me. When he heard me speaking, a bystander came into the compound and ran after the man. The man pursued him, but he was too fast for him to capture. She said, "The man returned and took me to see my grandmother, explaining what had happened to her." Julius Ajibare, the prosecution, brought six witnesses and presented the victim's photos, the defendant's statement, and a medical report as evidence to support his case.
Oluwaseun Oyebanji, the defendant's attorney, spoke on his behalf, however he did not call any witnesses.
He begged the court to balance justice and mercy even though he denied having committed the crime.
"In this case, the victim consistently, unequivocally, and unshakably stated that the defendant, who was well known to her, was the person who raped her," Justice Olatawura said in delivering his verdict.
"Overall, I find evidence that the defendant sexually assaulted the 13-year-old girl on December 25, 2021, beyond a reasonable doubt, and as a result, I find him guilty as charged." In light of the aforementioned, the defendant receives a sentence of "Life in prison," the judge decided.
